Terms of Service

1. Agreement

By creating an account or using www.achromic.ai (the "Service"), you agree to these Terms. If you use the Service for an organization, you represent that you can bind that organization.

2. The Service

Achromic lets you create AI-generated polls, distribute them by email, SMS, web, QR, AI voice calls, and research panels, and receive AI-generated analysis of the responses.

3. Your Content & Your Responsibilities

• You retain all rights to the content you create and the data you collect. You grant us the license needed to operate the Service on your behalf.
• Consent: you warrant that you have all legally required consents to contact every person on lists you upload or sync — including prior express consent where required for automated calls and texts (e.g., under the U.S. TCPA) — and that your use complies with applicable laws such as TCPA, CAN-SPAM, GDPR, and equivalents.
• No protected health information: do not use the Service to collect PHI or other special-category data requiring safeguards we do not provide (we do not offer BAAs).
• You are responsible for the lawfulness of your questions, audiences, and use of results.

4. Acceptable Use

• No harassment, deception, or discrimination; no content that is unlawful where you or your respondents are located.
• Do not contact people who have opted out. We enforce suppression across channels.
• No attempts to probe, disrupt, or overload the Service, or to misrepresent AI callers as human when disclosure is required.

5. AI Outputs

Poll questions, extractions, themes, forecasts, and reports are generated by AI and can contain errors. They are provided for informational purposes; verify before relying on them for significant decisions. They are not professional (legal, medical, financial) advice.

6. Plans, Metered Usage & Billing

• Paid plans bill monthly in advance via Stripe; metered usage (voice responses, Audience+ panel respondents, overages) bills per use at the rates shown on the pricing page at the time of use.
• You can cancel anytime from the billing portal; cancellation takes effect at the end of the billing cycle. Fees already incurred are non-refundable except where required by law.
• We may change prices with at least 30 days' notice; changes apply from your next cycle.

7. Our IP

The Service, including software, design, and branding, is ours or our licensors'. These Terms grant no rights in it beyond use of the Service.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, and our total liability under these Terms is capped at the fees you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.

10. Indemnification

You will defend and indemnify Achromic against third-party claims arising from your content, your lists, or your breach of Section 3 — including claims that outreach you commissioned lacked required consent.

11. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that materially breach these Terms, with notice where practicable. Upon termination we delete or return customer data per the Privacy Policy.

12. Changes & Contact

We may update these Terms; material changes will be notified in-app or by email at least 14 days in advance. Continued use after the effective date is acceptance. Questions: legal@achromic.ai.
